Please read these Terms of Service carefully before using PinoyISP. By creating an account or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("ISP Client," "you," or "your") and PinoyISP ("we," "us," or "our") governing your use of the PinoyISP platform and related services.

By registering for an account, you represent that you are at least 18 years old, have the authority to enter into this agreement on behalf of your business, and agree to comply with these Terms and all applicable Philippine laws and regulations.

2. Description of Service

PinoyISP provides a cloud-based Software-as-a-Service (SaaS) platform that includes:

  • Subscriber billing and invoice management
  • MikroTik router integration and PPPoE management
  • Customer self-service portal
  • Staff and role management
  • Network design tools (Fiber Network Design, WireGuard VPN)
  • Reports, analytics, and data export tools
  • ISP public website builder
  • Other features as described at pinoyisp.com

We reserve the right to modify, add, or remove features at any time with reasonable notice to existing clients.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Provide accurate and complete information during registration
  • Keep your password secure and not share it with unauthorized parties
  • Notify us immediately at [email protected] of any unauthorized use of your account
  • Ensure your staff accounts are used only by the designated individuals

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

4. Subscription Plans and Payment

PinoyISP offers multiple subscription tiers including a Free plan and paid plans (Basic, Pro, Enterprise, Unlimited). Current pricing is displayed at pinoyisp.com/pricing and in your dashboard.

  • Free plan: Available at no cost with feature and subscriber limitations as described
  • Paid plans: Billed monthly in Philippine Pesos (₱). Prices are subject to change with 30 days' notice
  • Payment: Accepted via GCash, Maya, or bank transfer. Access to paid features is granted upon confirmation of payment
  • No refunds: Subscription fees are non-refundable. You may cancel at any time and retain access until the end of the paid period
  • Subscriber limits: Each plan has a maximum subscriber count. Exceeding the limit requires upgrading to the next plan

5. Your Responsibilities as an ISP Client

As an ISP using PinoyISP to manage your subscribers, you are the Personal Information Controller under the Data Privacy Act of 2012. You agree to:

  • Obtain proper informed consent from your subscribers before entering their personal data into PinoyISP
  • Provide your subscribers with a privacy notice explaining how their data is used
  • Use the platform only for lawful purposes consistent with Philippine laws and regulations
  • Not enter false, fraudulent, or misleading subscriber data
  • Ensure your staff use the platform in accordance with these Terms
  • Maintain accurate billing records and comply with DTI/NTC regulations applicable to your ISP business

6. Acceptable Use

You agree NOT to use PinoyISP to:

  • Violate any Philippine law or regulation
  • Process personal data for purposes other than those disclosed to your subscribers
  • Attempt to gain unauthorized access to other ISP accounts or our systems
  • Reverse engineer, decompile, or attempt to extract the source code of the platform
  • Resell or sublicense access to PinoyISP to third parties without written consent
  • Upload malicious code, viruses, or conduct denial-of-service attacks

Violation of these terms may result in immediate account suspension without refund.

7. Data Processing Agreement

By using PinoyISP, you enter into a Data Processing Agreement with us under which:

  • You (the ISP) are the Personal Information Controller for your subscribers' data
  • PinoyISP is the Personal Information Processor acting on your documented instructions
  • We will process subscriber data only as necessary to provide the platform services
  • We will implement appropriate technical and organizational security measures (as described in our Privacy Policy)
  • We will assist you in responding to data subject rights requests to the extent reasonably possible
  • We will notify you of any data breach affecting your subscribers' data without undue delay

8. Intellectual Property

The PinoyISP platform, including its code, design, features, and content, is owned by PinoyISP and protected by Philippine intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your ISP business.

You retain ownership of the subscriber data you enter into the platform. You grant us a limited license to process that data solely to provide the services.

9. Service Availability and Support

We strive to maintain high availability of the platform but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible.

  • Free plan: Community support via documentation
  • Basic / Pro: Email support at [email protected]
  • Enterprise: Priority email support
  • Unlimited: Dedicated support

10. Limitation of Liability

To the maximum extent permitted by Philippine law, PinoyISP shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the platform
  • Revenue loss due to platform downtime or feature unavailability
  • Loss of data due to circumstances beyond our reasonable control
  • Actions taken by MikroTik routers based on platform instructions (subscriber suspensions, profile changes)

Our total liability shall not exceed the total fees you paid to us in the 3 months preceding the claim.

11. Termination

Either party may terminate the service relationship at any time:

  • By you: Stop your subscription from the dashboard. Your data will be retained for 90 days, after which it will be permanently deleted
  • By us: We may suspend or terminate your account for violation of these Terms, with or without prior notice depending on severity
  • Non-payment: Paid features will be downgraded to the Free plan if payment is not received within 15 days of the due date

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.

13. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by email and by posting the updated Terms on this page. Your continued use of the platform after the effective date of the updated Terms constitutes acceptance.
